  1. General
    1. This page (collectively “the Terms”) contains the terms and conditions on which you may make use of the www.uptothemoon.com website (“the Website”).
    2. We may update the Terms from time to time and will notify such changes to you by uploading them on the Website. You should review the Terms periodically for changes.
    3. By using the Website you agree to be bound by the Terms. If you do not want to be bound by the Terms, please do not use the Website.
  2. About us/Contact
    1. "Up to the Moon" is the trading name of F65 Up to The Moon Ltd, a limited company registered in England and Wales under company number 8083136. Our registered address is 20 Queen Street, Ipswich, Suffolk IP1 1SS. VAT Number 135 6796 80. You can contact us by email at help@uptothemoon.com. Telephone 01473 487444 for customer and trade enquiries. 
  3. Use of the Website
    1. Use of the Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on the Website without notice. We will not be liable if for any reason the Website is unavailable.
    2. Any personal data and other information provided by you is processed by us in accordance with our privacy policy, and any relevant legislation in force at the relevant time. By providing any such personal data or other information you agree to the above. We do not store credit card details nor do we share customer details with any third parties.
    3. If you are provided with any information as part of our security procedures, you must treat such information as confidential. We have the right to disable any user identification code or password if in our opinion you have failed to comply with any of the provisions of the Terms.
    4. Please note that all products on the Website are not intentionally sold as being suitable for children under 36 months of age. Up to the Moon will therefore not accept responsibility for liability with regard to any claims of this nature. 
  4. Our intellectual property
    1. We are the owner or the licensee of all intellectual property rights in the Website, the material published on it, and the goods and services that we provide. That intellectual property is protected by copyright and other related laws. All such rights are reserved.
    2. You must not use any part of the materials on the Website for commercial purposes without our permission.
  5. Our contract with you
    1. Each order you place shall be deemed to be an offer by you to purchase the goods and/or services specified within it subject to the Terms.
    2. We will send you an Order Acknowledgement Email to confirm that we have received your Order.  This Order Acknowledgement Email does not form a Contract between us.  When we have prepared your Order for Dispatch, we will send you a Dispatch Confirmation Email.  The Dispatch Confirmation Email represents our formal acceptance of your Order and forms our Contract with you.  Any products on your original Order that are not confirmed in the Dispatch Confirmation Email do not form part of our Contract with you.
  6. Pricing and product representation
    1. We do our best to ensure that all prices quoted on the Website are accurate.  All prices are verified before your Order is dispatched.  If verification shows that the correct price of a product is lower than that stated on the Website, we will charge the lower amount and send you the product.  If verification shows that the correct price of a product is higher than that stated on the Website, we reserve the right to either contact you for instructions before dispatch or cancel your order and notify you of such cancellation.
    2. We do our best to ensure that the descriptions and pictures of product are up to date and accurate.  Please be aware though that sometimes the packaging, contents or colour of products may vary from those shown.  If you feel that the Website has given a misleading representation of a product, please contact us by email at help@uptothemoon.com.
  7. Payment
    1. Purchases may be paid for by using PayPal or a debit / credit card through our online payment facility. Cheques are also accepted if you email us on help@uptothemoon.com or to leave a message call Customer Services on 01473 487444 to arrange the order. All prices are in pounds sterling (£), and are payable in pounds sterling. All prices are inclusive of VAT. 
    2. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of so refusing or by reason of unwinding or suspending any transaction after processing has begun. 
  8. Delivery times
    1. Any delivery times quoted are estimates only, based on availability and normal delivery time in working days.  We will always do our best to achieve the stated delivery times, and will inform you by email when we foresee problems. 
    2. If your goods are in stock, Standard Delivery Charge and Large & Heavy Delivery Charge items are likely to take between 3-7 days depending on location. 
    3. Express Delivery means if an order is placed before 12:00 noon on a working day (Monday to Friday) it will be delivered on the next working day (Monday to Friday).  For the purposes of clarification, Saturdays, Sundays and national Bank Holidays are not working days.  Please note that Kid's Room Large & Heavy Delivery Charge items cannot be sent by Express Delivery. 
    4. Express Delivery is only available for non-remote UK mainland destinations.
    5. Saturday delivery can be arranged.  Please contact us at help@uptothemoon.com before placing an order.
    6. Pre-ordering will usually take up to 10 working days to be delivered.
  9. Delivery charges and delivery outside the UK mainland
    1. The Up to the Moon Free Delivery option for one or more products applies to the UK mainland and Northern Ireland only.
    2. Certain items that are large and/or heavy are not covered by the Standard Delivery Charge.  In these instances, the item will carry our Large & Heavy Delivery Charge, which is £ 7.95. Please note that Large & Heavy Delivery Charge items cannot be sent by Express Delivery. 
    3. The Up to the Moon will deliver to destinations outside the UK mainland and Northern Ireland by prior arrangement.  Please contact us by email at help@uptothemoon.com to arrange delivery to destinations outside the UK mainland and Northern Ireland. 

    Delivery costs for parcels up to 30 kilos not greater than a total of 1.5m x 3m diameter will be:-

    Please email help@uptothemoon.com for prices anywhere else in the world. If you order goods from the Website for delivery outside the UK mainland and Northern Ireland, they may be subject to import duties and taxes that are levied       when the delivery reaches the specified destination. We have no control over these charges, and they are your sole responsibility.

  10. Returns
    1. If you wish to discuss or organise a return, exchange or refund of any item, please contact us by emailing help@uptothemoon.com or by phone on 01473 487444 (Mon-Fri 9am - 5pm).
    2. We endeavour to provide quality, carefully packaged products and we hope you love your new purchases. However, we offer a no-quibble returns policy on all our products, whatever the reason – even if you have just changed your mind. All we ask is that you return the goods to us within 14 days of receipt, with a note giving us the reason for the return, and whether you would like an exchange or refund. Please be aware that proof of posting is NOT proof of receipt and for this reason we recommend you use a signed-for insured postal service.
    3. If we find that the product has not been returned to us in fully resaleable condition, Up to the Moon reserves the right to refuse a refund on the item, or deduct up to 20% of the original selling price from the refund amount.
    4. If an item you have received is damaged, please inform us within 24 hrs of delivery to arrange for a replacement to be sent. In the case of faulty goods, we will reimburse you in full (the cost of the product and postage). In the case of non-faulty goods, we will reimburse you for the cost of the product only. Please ensure that these are returned unused and in their original condition (including the packaging).

  11. Cancellations
    1. If you haven’t submitted your order, simply clear the items from your shopping basket at any time by clicking the ‘Remove item’ link below the product you do not wish to purchase in you shopping basket. If you’re unsure about a product, you can check ‘Postpone’ and apply changes. This will remove the item from your basket, and place it in a ‘Postponed items’ area. If you want to place the item back into your basket, simply uncheck the ‘Postpone’ box and apply changes once again.
    2. If you have placed an order and wish to change or cancel it, please contact us as soon as you can. We’ll do our very best to make your requested changes, but we cannot guarantee that the order won’t have been processed already. If this is the case, you may have to wait until you receive the order and then follow our Returns procedure.
    3. Once we know you wish to cancel an order, Up to the Moon will refund the value of your order to the credit or debit account used to pay for the goods within 30 days of your order (provided the goods you return are in the same condition that they were when delivered to you). You’ll have to pay any charges incurred when returning the goods to Up to the Moon, unless the return is as a result of an error on our side.
    4. Up to the Moon complies with the OFT’s Distance Selling Regulations. This means Up to the Moon customers in the European Union that cancel their order within seven days after the day they receive their goods, and cancel the whole order, will receive a refund of the standard postage and packing costs paid as part of that order (if any). Sorry, but you will have to pay the costs of sending the order back to us. We will not refund any postage and packing charges if you cancel after the seven days allowed under the Distance Selling Regulations or if you only cancel part of your order (although you still have two weeks to return your goods per our returns and refunds policy).
  12. Links to the Website
    1. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
    2. The Website provides links to other websites for your information. We have no control over such sites and accept no responsibility for them.
  13. Misuse of the Website
    1. You must not misuse the Website by knowingly introducing viruses, Trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website. You must not attack the Website via a denial-of-service attack or a distributed denial-of-service attack.
    2. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Website will cease immediately.
    3. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Website or to your downloading of any material posted on it, or on any website linked to it.
  14. No waiver
    1. If we fail at any time to insist upon strict performance of any of your obligations under the Terms, or if we fail to exercise any of the rights or remedies to which we are entitled under them, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
    2. A waiver by us of any default shall not constitute a waiver of any subsequent default.
    3. No waiver by us of any of the Terms shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.
  15. Severability
    1. If any of the Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
  16. Entire agreement
    1. The Terms and any document expressly referred to in them represent the entire agreement between us and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
  17. Force majeure
    1. Where we are prevented from or delayed in the carrying on of our business due to circumstances beyond our reasonable control, the date of delivery shall be postponed for the period that the circumstances continue.
  18. Applicable law and jurisdiction
    1. Contracts for the purchase of goods and services through the Website are governed by English law. Any dispute arising from, or related to, such contracts shall be subject to the jurisdiction of the courts of England and Wales.
  19. Feedback
    1. General comments about the Website are welcome by email to help@uptothemoon.com. Any complaints should be sent to the same address.
  20. Privacy Policy

      Your privacy is important to us. We only use the information we collect about you carefully, lawfully and in accordance with the Data Protection Act 1998. Information we hold:

    1. We do not store credit card details nor do we share customer details with any third parties.
    2. If you have shopped with us we will hold your name, address, telephone number and email address. We will also hold the delivery address(es) for your orders and the password information associated with your account. We also maintain a record of your product selections. We do not retain your financial details.
    3. If you have requested to receive our email newsletters we only hold your name and email address. If you wish to unsubscribe please follow the instructions at the bottom of the email you have received
    4. We use the information we hold on your records for operational purposes; for example processing your order, dealing with queries, tracking deliveries, reviewing past purchases.
    5. Your order history enables us to tailor our product range and marketing information (e.g. promotions and special offers) to your requirements.
